These Terms & Conditions govern the use of the MSMAuctions website and participation in sales/auctions conducted by MSMAuctions. By accessing this website or participating in an sale/auction, you agree to be bound by these terms.

1. Auctioneer Authority

MSMAuctions acts as agent for the seller and is authorized to conduct auctions, accept bids, and enforce auction terms on behalf of the seller.

2. Registration & Eligibility

Bidders may be required to register prior to bidding. A valid government‑issued photo ID is required.

MSMAuctions reserves the right to refuse registration or bidding privileges at its discretion.

3. Buyer’s Premium

A 10% buyer’s premium will be added to the final high bid unless otherwise stated in the auction‑specific terms.

4. Sales Tax

Applicable sales tax will be collected from the buyer unless a valid tax exemption certificate is provided prior to payment.

5. Payment Terms

Payment is due as stated in the auction terms, typically on the day of sale or within the timeframe announced.

Accepted payment methods include all major forms of payment. Checks require proper identification.

6. AS‑IS, WHERE‑IS Condition

All property is sold AS‑IS, WHERE‑IS, with no warranties or guarantees, expressed or implied. Buyers are responsible for inspection and due diligence prior to bidding.

7. Removal of Property

Buyers are responsible for removal of purchased items within the posted removal period. Risk of loss transfers to the buyer at the fall of the hammer.

8. Default

Failure to comply with payment or removal terms may result in forfeiture of deposits, resale of items, and/or legal action.

9. Real Estate Auctions

Real estate auctions are subject to auction‑specific terms, including earnest money requirements and closing timelines. Buyers should review all terms prior to bidding.

10. Limitation of Liability

MSMAuctions is not responsible for errors in descriptions, omissions, or conditions of property. All announcements made on auction day supersede printed or online materials.

12. Governing Law
